Extension Of Working Hours For Factories In Uttar Pradesh



Dear Readers,

Government of Uttar Pradesh vide notification no.No. 13 /2020/ 502 /XXXVI-03-2020- 30 (Sa.)/2020TC has exempted all factories registered under The Factories Act, 1948 in the state from the provision of Section 51 (Weekly Hour), Section 54 (Daily Hour), Section 55 (Interval Of Rest), Section 56 (Spread Hours), Section 59 (Extra wages for overtime) with effect from 20th April 2020 till 19th July 2020 subject to aforesaid conditions.

Conditions are as below;

·        No adult worker shall be allowed or required to work in a factory for more than twelve hours in any day and Seventy-two hours in any week.
·        The periods of work of adult workers in a factory each day shall be so fixed that no period shall exceed six hours and that no worker shall work for more than six hours before he has had an interval for rest of at least half an hour.
·        Wages shall be in proportion of the existing wages. (e.g. If wages for eight hours are 80 Rupees, then proportionate wages for twelve hours will be 120 Rupees.

Dear Readers,

In the view of COVID-19 and the available percentages of Factory employees in the state, Under Sec 65(2) of Factories Act 1948 in Maharashtra State those factories who are enduring less operational strength of employees, an extension given to the employees under Sec. 51,52,54 & 56 of Factories Act 1948 up to 30th June 2020;

Greetings from Classic Labour!!!!

The Government of Maharashtra vide notification No.FAC-2019/C.R.157/Lab-4 has amended the Maharashtra Factories Rules, 1963 by introducing new provision in Rule 45.

As per the amendment, the arrangement of sanitary napkins, disposable bins in women’s toilet with lids and measures for disposal of waste as per approved procedure from Inspector have been mandated.

Factories Act 1948 - Maharashtra Rules - Revised (Basic) Minimum and VDA notification

Maharashtra minimum Wages act notification has been published vide circular dated 05.08.2019, and the VDA for Factory Establishment declared Rs. 4725/-. 

However in the same month another notification vide circular dated 30.08.2019 was issued by Industries, Energy and Labour Dept. under Minimum Wages act for Factory Establishment; 
according to the said notification, it is mentioned that the Basic Wages for Factory workers has been increased as compared to their last Basic wages as per the Zone and Category wise.

Hence, confusion was created in the mind of the Establishment/Employers which Minimum Wages declared (Basic + VDA or Basic wages) needs to be implemented.

To clear the confusion another notification vide circular dated 19.09.2019 was issued in which it was clearly mentioned that the old Basic +  VDA of  Rs 4725 is applicable only from 01.07.2019 to 29.08.2019; and w.e.f 30.08.2019 to 31.12.2019 there will no VDA applicable only Basic Wages is applicable for the Factory Establishments.
